Can a 21 year old adult in America, get in trouble for allowing a 20 year old to drink alcohol?

Does the 20 year old get in trouble and nothing happens to the 21 year old, even if the 21 year old knew the person in question was underage?

Don't ask me why I am asking this. Just curious really. I don't study laws.

both can get in trouble, one for supplying to someone under 21, one for drinking under 21.

but if you think someone would possibly tell on you i dont know why you'd give them alcohol.

Well no...the 21 year old hasn't supplied anything. He/she is simply in the presence of the 20 year old knowingly allowing them to drink and not saying anything. I think that's contributing to the dilenquecy of a minor if they are under 18, even if they didn't supply the alcohol, but over 18?

Edit: And this is just in theoretical situation. My wife asked me this question tonight and I really didn't have an answer. I figured what better place to ask than...Oprano.

This falls under local and state law, but in most places if the 21 year old PROVIDES the alcohol to the 20 year old, they can face some harsh penalties.

It is more detailed than that man, No is the simple answear, if the 21 yr old did not supply the safe haven to drink in, or the liquor...

and was merely at the same place at the same time...

however if there are other mitigating circumstances, such as they are at the 21 yr olds house, or in his/her car etc.. or if they are at the park together just the two of them and get caught with liquor then yes the 21 r old is in trouble.

Personal experience...

Me (24yo at the time) and 6 jarhead buddies (18 to 20 in age) from Camp Pendleton on weekend liberty sipping beer on the beach in Cali in 1989. Cops showed up, the youngsters all got fined for underage drinking and I got cited with Contributing to the Delinquency of Minors.

AND the cops made us pour out nearly a case of beer on the beach.

So yes, said 21yo is culpable under the law - even if s/he is a US Marine.

A 20 year old can't legally buy booze so you'd have a helluva time convincing the police that if a 20 and 21 year old are sitting around drinking, the 21 yo didn't do the purchasing.

In GA, I can serve alcohol to my son in my house no matter what age he is. The legal stuff kicks in if he does something stupid under the influence.

I remember cops in my hometown got a call during high school grad night party "weekend" the parents wanted to make sure their partygoers weren't going to have their cars towed for staying all night, they wanted to be responsible and not give anyone who was drinking their keys back. So the cops came and busted the parents and all the kids with alcohol in their hands. Lame fucking town.

But nick, if the 21 yr old is supplying the PLACE (their appartment) then yet they can get in trouble. If i'm 21 and at a place where under 21 year olds are drinking, and it aint my place, of course im not getting in trouble (unless im the only 21 yr old there or people tell the cops I bought the beer).

El Wrongo. Sorry bro, but if you are of legal age and are in a situation where underage folks are drinking - unless perhaps said underagers LIVE there and their PARENTS gave them the alcohol - you are fucked under the law.

You see, the law expects you, the legal aged idiot in the situation, to have enough brain power to either stop them from drinking "your beer" (that's how the law sees it), or to completely divorce yourself from the situation. Failure to do so puts you in the driver's seat of "Oh shit, I'm fucked".

The law, realistically speaking, doesn't give a rats ass where the under agers got their booze. You, the "adult" are there and therefore responsible. If they aren't your biological/legal kids then YOU are committing a crime by allowing them to drink.

I'd have been completely safe when I got busted on the beach in Cali, but one of my troopies came up holding a Bud and tried to "help his Corporal out with the Coppers". I'd have walked away with a $50 fine for drinking on the beach, or perhaps just got a warning. But NOOOO! As soon as my troop walked up obviously drunk and holding one of "my" beers the cops had no choice but to cite us all. Cost me a pretty penny to keep my troops out of jail and pay their fines upfront too so they wouldn't have to stand before the 1st Sgt and explain how they were drunk and underage, much less ME standing before the man and explaining how I managed to get almost an entire squad of Marines arrested, LOL...

I HATE the fact that 18yo people can vote, can be enlisted, can be voted into public service ... yet they can't drink??? I even wrote a thesis on this back in my college days.

Yet .... I see daily why 18yos shouldn't drink and maybe they SHOULD be cannon fodder. LOL, I live in an environment where I see fucktards of extreme potential and ZERO motivation to be anything but a no-belt-wearing, attitude talking, wannabe gangstah. And I think to myself .... "Self? Should we just kill them and rid ourselves of the problem?"

I'm digressing, eh? Ok, time to shut up for now.

Venturi, I'm not going to take the time to look it up, you may be right. But there's no way in hell if you are at a party at someone elses place, and half the people are under 21, that you are getting in trouble, unless someone says something about you.
