(AP) "WASHINGTON - The House overwhelmingly passed legislation Thursday substantially increasing the maximum fine for radio and TV indecency.

The vote was 391-22. Similar legislation is pending in the Senate. "

Substantially increasing it to *what* exactly?
I think the guidelines as they are now are fine - they just need to be enforced more. Kinda like gun control laws.

Of the 391 congressman who voted yes on this, how many are democrats? It seems like this is a overwhelming percentage 90%+ must be bipartisan.

Democrats are just as responsible as Republicans it appears.

To think other wise is naive.

All politicans are going to rally against "indecency"

Hey Vick!

Today "indecency" is Janet's tit (even sans nipple), Howard Stern in general, and anything that offends the gentle sensibilities of the Christian right.

The FCC presently defines "indecency" as:

Language or material that, in context, depicts or describes, in terms patently offensive as measured by contemporary community standards for the broadcast (or cable) medium, sexual or excretory activities or organs.

Despite George Carlin's comedy routine, "Seven Forbidden Words", there is not an official list maintained by the FCC:

Hey LL

Actually I found Jackson's nipple bit at the Super Bowl to be indecent but ....

.... not because it was a body part that can be seen with sexual connotations, (as I've stated many times women are the most beautiful creation nature made)
but because it was a contrived act, actually the sheer commercially of it goes beyond indecency to all out gross

also if my 31 month old son would have seen it and asked about it I have no problem explaining a beast and also why someone at a challenging time in their career as a performer may choose that path for publicity

But then again I can't expect everyone to be able to or want to do the same with their children

Vick:

I loved that typo!

When my daughter was 3 years old, I heard her singing along to this:

I knew a girl named Nicki
I guess you could say she was a sex fiend
I met her in a hotel lobby
masturbating with a magazine

Of course she was clueless about the meaning of the words.

Yep with the former tenet of the buiilding I bought. I went out of my way to help her and her company, and she is trying to fuck me.

I came up with a settlement for her to opt out of the lease early, then she wanted to stay an extra month ( which put me way behind - setting up my office moving from New Orleans).
I had a very similar thing happen to me once. Very frustrating.

Committee Passes Broadcast Decency Enforcement Act

The Committee on Commerce, Science, and Transportation Tuesday passed unanimously by roll call vote S. 2056, the Broadcast Decency Enforcement Act.

The Broadcast Decency Enforcement Act would, as introduced, increase tenfold the cap on fines the FCC may assess on television and radio broadcast licensees for obscene, indecent, and profane broadcasts.

Senators Brownback (R-KS), Allen (R-VA) and L. Graham (R-SC) introduced the bill on February 9, 2004.

The Committee passed the following amendments to S. 2056:

>An amendment sponsored by Senators McCain (R-AZ) and Brownback to permit the FCC to count each utterance or showing of indecent material as an individual violation, require the FCC to consider several factors when assessing a fine and cap the total for all fines assessed on any broadcast licensee in a given 24-hour period at $3 million.

>Three second-degree amendments by Senator Stevens (R-AK) to provide escalating fines for violations so each subsequent violation results in a larger fine, to authorize the FCC to increase fines because of the specifics of an audience, and an amendment co-sponsored by Senator Lautenberg (D-NJ) to direct the FCC to hold a mandatory license revocation hearing after three indecency violations.

>An amendment by Senators Hollings (D-SC) and Stevens to protect children from violent programming.

>An amendment by Senator Stevens to authorize broadcast associations or networks to enter into agreements to provide family programming during certain hours in a broadcaster's prime time schedule.

>An amendment by Senators Stevens and Allen to authorize fines not to exceed $500,000 for individual non-licensees for any violation.

>An amendment by Senators Ensign (R-NV) and Burns (R-MT) to allow the commission to consider the violator's ability to pay a fine when assessing a fine.

>An amendment by Senators Dorgan (D-ND), Lott (R-MS) and Snowe (R-ME) to require the General Accounting Office to conduct a study on the relationship between the consolidation of media companies and the increasing indecency violations, and instituting a moratorium of the FCC's June 2, 2003 broadcast media ownership rules until the study is complete.

be afraid.

be very very afraid.

i suppose it's futile to point out that this discussion is 1000's of years old, as are the concerns, fears, paranoia and insecurities. though some continually argue that things have never been worse... i think it can be soundly argued that things have never been better.

I think a fair analysis is that both of the popular US parties are anti-porn and anti-indecency, that more Republicans are and that the most fervent ones are Republicans.

Rep. Gary Ackerman (D-N.Y.): Never would I have thought that defending the Constitution in this House would be a lonely job ... I believe in decency, I believe in Mary Poppins, I believe in all things nice but what is at stake here is freedom of speech."

Rep. Mike Pence (R-Ind.): "This is not about free speech ... this is about decent speech within the constitutional standards that every broadcaster should uphold."

VOTING:
Republican 218 YES, 1 NO, 8 NO VOTES
Democrat 172 YES, 21 NO, 11 NO VOTES
Independent 1 YES

I'll say it before and I'll say it again. The history of the 20th century social machine was one of increasing licentiousness and civil freedoms. You'd have to be blind not to see that. WE have WAY more rights than we had 30 years ago, 60 years ago or 100 years ago. In the US, half the population couldn't even vote a century ago. Overall, society is much more licentious than it was just two decades ago. Look at the popular TV programming of not too long ago ("Leave it to Beaver", "Brady Bunch", "Happy Days"). Look at what used to be a PG movie compared to today.

Explain to me how we have less rights today compared to an era where alcohol was illegal in the US.

Explain to me how we have less rights today compared to the McCarthy era.

Explain to me how we have less rights today compared to an era when a couple could not be shown laying in bed together.

Explain to me how we have less rights today compared to an era when a person couldn't play in professional sports because of the color of their skin.

Explain to me how we have less rights today compared to an era where women couldn't vote.

Explain to me how we have less rights today compared to an era where a person had to sit in the back of the bus if they were black.

Explain to me how we have less rights today compared to an era when a shop owner could hang a sign on their door telling people of various ethnic groups to stay out.

Let freedom ring!

You think Howard Stern is a controversy today?

Not too long ago, people were up in arms over Elvis shaking his hips.

Absolutely, we have more rights than we did 30 years ago, but less than we had 5 years ago.

And we are rebuilding the Mc Carthy era right now, only replace Communist with Terrorist.

Indefinate detention of suspects without charging them with a crime or allowing them access to a lawyer....

Unrestricted use of wire taps without a warrent...

The ability to take all assets of a "suspect" proven guilty of nothing

The FCC making arbitrary determination of what is "offensive" with no actual rules for broadcasting (a group appointed by and answerable only to the Furer, er, ah, president) Maybe the FCC should be renamed the ministry of Propaganda

Today you can't say Fuck, Tomorrow ass, what comes the day after ?

This bill is about much more than Janets Nipple, or Stern talking about anything. It gives the President the power to silence anyone speaking against him or her.

I am not looking at conspiracy theory, I am looking the long term effect of the recently passed laws.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

Faith based initicitives and the current bill shatters that one.

A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed

The current ban on automatic weapons shits on that one.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

RICO and Patriot Act make that one meaningless.

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Patriot Act again

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

Patriot Act again

September 11th created a new "EVIL" and we are happily giving away our liberties so the Government can keep us safe.

Stevie Wonder could see we are moving in the wrong direction for freedom

Insert Gay everywhere you posted black - It is legal in much of the country to fire someone from their job because they are Gay, name one Baseball, football, basketball, or Hockey player that is openly gay.

We also have not come even close to erradicating racism as many of your examples point to

I didn't say that anything has been eradicated only that the general direction has been in a positive direction as far as "rights".

Nearly every perceived crisis results in something like the Patriot Act. It's happened at least a half dozen times in US history - probably a dozen depending on what you want to count. Each such crisis provoked a reaction and then an increasing reaction to the reaction and finally a reversal. Right now we're in the increasing reaction to the reaction stage. It was this way right at the beginning of the US as a defensive mechanism during the Revolutionary War and it's this way now. Nothing new to see here.

Trying to discern a long-term pattern from 5 years of - what I'm not really sure because it is all pretty normal - seems completely fruitless to me. There's nothing out of the ordinary here. We've had all the same "controversies" over and over again throughout the history of media.
Whether it's the New York Times or MTV, Elvis or Janet Jackson, 50s rock and roll or 90's gangster rap, Mark Twain or Nabokov, 2 Live Crew or Eminem, "Last Temptations" or "Passions" it seems to me we're just on repeat except when they happen again we've usually moved much further towards the libertarian standard. Elvis shook his hips, Janet flashed her tits and in 20 years someone will pull down their pants on MTV and we can have the same argument again.

Every decade has produced it's free speech trials and defense. What happens, I think, is we forget how important those events seemed at the time - each one inviting comparisons to the Soviet Russia, Nazi Germany, or lately the Taliban and Saddam's Iraq.

So history repeats itself and it is normal for you to see it?

Witchcraft!!!

Haha. Must have been this line "provoked a reaction and then an increasing reaction to the reaction and finally a reversal".

The best thing that could happen to the industry is if the Republicans start waging war on porn. We'll all be multi-millionaires in a year.

Buff, are you agreeng to be Bubba's bitch in prison as front man for us all?

Things went too far to fast, the religeous right screamed loud, and things are happening. Their ability to be heard is based on who is the current president, and who sits in the positions of power in the house and senate.

At this moment, the US government is a pretty religous bunch, and as a result, the RR are heard more clearly by people atuned to their message.

Meese, the moral majority, and other groups like that flourish when the government is more likely to listen. They tend to dissipate or get pushed to the back of the crowd when there is a more neutral government in place.

It is a cycle. This one is no different from the "Three's Company / Charlies Angels " era of television, where many from the RR were upset to see Farrah without a bra or to see Chrissy bouncing around for all to enjoy.
