Hey guys - I wanted to drop a quick note and let everyone know that this coming Tuesday, 11/25/2003 6:00pm EST @ http://www.arsradiox.com we will have a Question & Answer regarding Patent Law & Ligitation with a panel of 3 IP lawyers.

The purpose of this show will be to help give a basic education about Patent Law & Litigation. We will not cover any specific lawsuits in this Q&A. The more educated we as a community are in these matters, the better decisions we can make and the less likely we will be 'bullied' around by people who feel we're an easy target.

This is a MUST hear show and we invite EVERYBODY to attend. The material covered here is worth a TON - We'll be covering the exact same topics and questions that I've asked of my IP lawyers. Best of all, its absolutely FREE!!

Again I look forward to seeing everyone there.

Good job Marc!

If I don't get to call in - I have one question that maybe you can have them answer:

I know that with copyright lawsuits, they have to sue you in the state where you live and operate....... is this also the case with Patent lawsuits? or does it make any difference where your server is vs where you actually are incorporated or where your office is?

I think that key question makes a lot of difference to the Acacia ability to sue webmasters.

Here is some more information regarding the show tomorrow.

Advertising Revenue Service (http://www.adrevservice.com) (ARS), a premier pay-for-performance affiliate marketing network, is sponsoring the live broadcast of a panel discussion on patent and intellectual property law with some of the top legal practitioners in the U.S.

The live broadcast is scheduled for Tuesday, November 25 at 6 p.m. EST (3 p.m. PST). Please go to http://www.arsradiox.com for complete details.

“This show was set up to provide webmasters with general information relating to patent law and litigation,” said Becky Deforest, CEO of ARS. “The more informed we are, the better decisions we can make. I encourage everyone to join in for this informative presentation.”

Richard McKenna, partner in the national law firm of Foley & Lardner, will lead a panel of patent specialists to discuss the hot issues in patent law as it is applied and practiced in the Internet Age. Issues to be discussed include:

- Overview of the patent application process

- Enforcement of Patents including:

o Cease and desist letters

o Licensing

o Litigation process, such as discovery, Markman hearings, trial, and appeal

o Damage calculation

o Contributory infringement and inducement to infringe a patent

McKenna will be joined on the panel by Foley & Lardner lawyers Jeff Costakos, a partner specializing in patent litigation, and Paul Hunter, an associate specializing in counseling and patent prosecution of business method and Internet patents.

About Foley & Lardner

Foley & Lardner is a national law firm with nearly 1,000 lawyers, with more than 100 practicing Intellectual Property law. Becky

Marc or Becky,

If you can squeeze it in, i'd like to know what the maximum possible penalty would be if patents were found valid and they were to sue a webmaster for infringing.

Could the judge award the cost of the license? 100% of the sites revenues? 1000% of the sites revenues?

I just want to know if the attourneys could give the worse case scenario for not paying a patent owners licensing fee.

thanks
