Any company big enough to put internet on every desktop also typically has terms of use in employee handbook that say dont use it for non-business purposes and specifically say anything adult can get you terminated.

In which case, you dont even necessarily have to toss him a warning first.

I'm sure that he signed some type of employment contract.

If he wins this case (which I highly doubt he will) this will open a huge can of worms.
