Well it seems that some content provider(s) have begun turning over their customer lists to Acacia media, anybody else get the Acacia packet in the past week?

Fuckers.

Did they send you something in the mail? Or was it in e-mail?

Mail. But because of the corporate name that was on the envelope we know that it came from a content provider.

Well Hoop, is it REALLY that big of a deal? We get tons of mail everyday. We get tons of junk mail from all kinds of companies. I personally get slammed with junk mail at my house...

It's a fact of life.... deal with it.

Surprising that you would even post, since you are a pretty successful "Bulk Mailer" yourself...

Mike,

I think you are not understanding what Hooper is pissed at, he's not mad that he's getting junk mail or spam, god knows I get enough Ryan's Beachhouse spam.

The mail he got was from ACACIA, that's the high tech shakedown artist company that says they have a patent on all Internet video streaming and they are going after tons of web companies trying to extort a licensing fee by threatening lawsuits.

Hooper thinks that one of the video content providers gave up his company info to ACACIA.

I received the packet as well last week, but it was addressed to Bestat and at the name and address I used at the Internext show, not the name I purchase content under. My assumption was they collected all the sponsor program names and addresses at the show, and did a blanket mailing assuming we all carry feeds on our paysites. I hope it is not as Hooper thinks, and someone is supplying names to them.

Yeah. Well we'll see what happens. I didnt exactly get the impression that they knew who we were or what we did, or even what url's we dont own.

Real Network's general counsel got a kick out of it though. I'll be hearing back from them next week on their thoughts.

You won't be hearing back from Real Networks general counsel. They wont speak to you about this. You won't be hearing back from Microsofts general counsel, they wont speak to you about this.

Hoop... some of us have actually already been sued. They haven't served us yet, but they have filed the suit. Case number and everything.

I also highly doubt that Real Networks general counsel even spoke to you.

We have been there.
We have done that.

This is a battle that is going to have to be fought. And won. If we lose, nobody will be immune. If you license feeds from ABC Sex Feeds company, and all you have is links to their server, you still, according to Acacia, will have to pay a licensing fee. Even though the feeds dont touch your servers, dont pass through your servers, dont come with in 300 miles of your servers, according to Acacia.. you will stall have to pay.

Nobody should be talking to these people. Everything should be directed towards Far-L. Let our lawyers do the talking.

Will sites having animated gifs also be sued?:

What about jpeg push or Flash?

I got 2 of these extortion packets from this company Acacia last year.
I don't know why the picked us, we have never streamed any content we just make it and license it. (No feeds)

They seem to have spent a lot of money on these packets in order to scare the adult industry into submission it would appear that they are quite serious about shaking the adult industry down.

The packets I received are currently in the circular file where they belong!!!

It did kinda catch me by surprise though, as nobody was talkin' about them back them.

The whole collecting names at Internext thing sounds like something the sneaky bastards woud do.

:grrr:

We also received the same package last year claiming that since we are a Dutch company we need to pay. Well, we are not a Dutch company , we just had an office in the Netherlands... And all our domains' whois info has this address.

One way or another, ACACIA either got the address from WHOIS or from some content provider (which is more likely).

I can tell you this....the initial packets that were sent out last year to those who were not sued, and the lawsuits that were filed against some of us, ALL came from the whois database. We know this for a fact because of certain misspellings and addresses used.

These new packets that are being received now most likely came from three sources:

1. More whois
2. Internext
3. Content providers who were stupid enough to talk these people and/or sign the license agreements. As part of the licensing package, content providers were required to give Acacia information on all of their customers. According to Acacia..the customer must also sign a license and pay.

If you get this packet.. DO NOT CONTACT THEM! Don't be stupid and think that you are smarter than them. Don't be stupid and think you can call anonymously and get information from them. They will get more information from you then you will get from them. Contact Far-L immediately. He will be able to provide you more information.

No..I was not intentionally being rude, I was being honest. I highly doubt that you spoke with Real Networks general counsel, perhaps it was someone lower down the food chain. Real Networks is far from "chuckling" about this. They have incredible exposure and liability here and they know it. Right now, they havent been sued and they havent been a part of this and until such time as they HAVE to become a part of this, they are going to keep their mouth shut.

For any of you that think this is a joke, it is not. It is very very real. Again.. contact Far-L for more information.

The answer to all of those is yes.

According to Acacia, the patent not only covers streaming media, but also, jpeg's, gif's, etc.

Contact Far-L for more information.
