Yeah but that's like arresting people for dubbing tapes, how many folks did time for that you think?

Ironhorse, sorry, you are incorrect.
if you dub a tape and give it to a friend, that is "okay". If you mass produce 10,000 tapes, and give them away on a street corner to whoever goes by, that isn't okay - and owning those tapes is a copyright violation. P2P systems do the same thing - they put people who otherwise don't know eachother in touch to exchange copyrighted material. They aren't your friends, they are just "out there". I hope more ISPs take action on this, because you also know that porn is traded in the same way. Alex PS: Anyone else notice that EBAY has a ton of website content being sold on compilation CDs and DVDs? Serious profiteering from stolen content, from what I can see. It's sad.

This is one of the things that's killing our own industry.
Some asshole sucks down an entire porn site and 2 hours latter he's got his own porn site CHEAP CHEAP!!! So what if he gets caught he's not going to be made to pay you $$$ for stealing it. Don't need to pay for porn while file sharing networks are free either!!! If you download free music through Morpheus etc... or bootleg software (Even Microsuck) for that matter you are promoting the activities which will eventually render most copyrighted materials non-profitable.

You guys are totally right about that, do you think that there is a way to stop it? I seems a bit like fighting a hydra to me, you take one down, 9 more sprout out.

Ironhorse, once someone gets taken down big and loud, there will be a change in public opinion. Someone will probably need to go after Ebay itself to get them to stop the resale of obviously copyrighted material, it is sick and overwhelming.
Our industry controls itself well in that sucking down a paysite and duplicating it doesn't work for long, because there are not that many ways to collect money, and Epoch and such are VERY understanding when it comes to this stuff. Without the earnings motive, most people trying to dupe a paysite disappear soon enough. Ebay and such are a different kettle of fish... anyone have some ideas? Alex

a letter to the media is a good start ;-)
dear new york times finance section here is an explanation of the problem and action that could be taken to prevent the theft of music from musicians. giving a journalist industry insight to the actions of major companies would certainly spark some legislation or at least stop the commercial companies like ebay from being involved. |

I'll tell you one thing that will help this situation.
Don't give the fuckers a link on any of our pages and the surfers will have to look really hard to find them. If Tucows (and others) would stop giving stealers a spot to download this problem would be lessened by 75%. If the search engines yanked their links it would be over for them. As a maker of copyrighted material Adult and Music I am being hurt finacially by these stealer programs. On Topniche about 2 years ago someone posted a link to an affiliate program for one of these adult morpheus type file sharing programs. I went on the board and blasted the shit out of them and told the board in no uncertain terms what would happen if we promoted this product. Talk about cutting your own head off. The entire board was uninterested though I did get one reply in agreement!!! The truth is that people don't care about anything 'till it affects them directly and by then it's too late!!!

Creating a law and then enforcing it is two different things.

You got the general idea, but you are missing the finer points.
This rulings give ANYONE access to ANY ISPs Customer private information just by saying his copyright is being infringed. Not need to present your case to a judge. ...which mean it might not be your content, it might not even be copyrighted, but YOUR ISP will give YOUR personal information to just about ANYONE ...and you guys are standing here applauding it... wtf?

So I'll address it now. I don't believe that my banking info should be given up by my bank without a warrant and I don't believe my ISP should give up my private information without a warrant either. The problem is that judges hand out warrants like candy nowadays with little or no evidence!!!! A warrant should have merrit and evidence in support of the action to be taken. You never hear about a judge loosing his job or having a pay damages to someone for signing a bogus warrant, do you? There should be accountability. They served a one of these worthless warrants on Verison and Verison is appealing it as most other ISPs were affraid to do.

Anthony, here is a question for ya:
You own copyrighted material, and you see it being downloaded to IP address. The Ip comes back as dsl12655.highspeedisp.us.org.net . You know the material is being downloaded (and worse, shared back out, you went and did a test download from that IP with kazaa). So, now you know there is a copyright violator right there. The only thing you have is the ISP. Technically, the ISP is the one downloading the content, because you have no proof otherwise. If they don't get up their client, they could be liable themsevles, because they control the IP, and what is the proof that someone from the company isn't doing the downloading? Remember the DMCA, you don't have to go to court to give notification. For the ISP to say "it's not me" they have to provide the "it's this person here".... End users should not EVER be able to hide behind an ISPs skirt - end users are responsible for their actions. ISPs are fools if they want to stand between the copyright holder and the violator, they could end up being in an "aiding and abetting" situation, I suspect. Otherwise, what would stop bob dsl user from setting up paysites with stolen content, knowing that the ISP will never reveal who he is? There is protection and then there is PROTECTION. Alex

Kazaa has a lot of these type of traps waiting:
W32/Oror-Fam is a family of worms, all of which are very similar to W32/Oror-B. Like W32/Oror-B, these worms can spread in an number of ways, including sending themselves out by email, copying themselves to shared drives in networks, and placing copies of themselves in folders likely to be shared via the KaZaA peer-to-peer system. The Oror family of worms also have many or all of the following characteristics: They pop up fake error dialogs to disguise their operation. They create copies of themselves in your Windows folder using innocent-looking names, typically incorporating the first few letters of the computer name backwards. They add a value to the registry key: HKLM\Software\Microsoft\Windows\CurrentVersion\Run so that they will launch automatically every time you log on. They edit WIN.INI so they will launch automatically every time you start your PC. They exploit bugs in older, unpatched version of Outlook, Outlook Express and Internet Explorer so that they may launch automatically when you view infected emails. They create mIRC scripts to distribute themselves if you have mIRC installed. You can find additional details about the W32/Oror family of worms by looking at the analyses of W32/Oror-B, W32/Oror-K and W32/Oror-L. |
