Illegal Spyware
The term "spyware" is most appropriately used to identify the behavior listed below. This behavior is illegal under existing law - Section 5 of the FTC Act, 15 U.S.C.§45 - as an unfair or deceptive act or practice.
"Spyware":
1. Gathers information from a consumer's computer without permission
2. Reports the information to the creator of the software or to one or more third parties
3. Is installed on a consumer's computer without having given adeguate notice to consumers
4. Provides the consumer with little or no control over removing the software
