If a civil suit is filed and you don't show up for court - you lose. Automatically. Some juridisdictions may allow one no-show, but I don't know of any.
If someone has tapped your phone they have violated laws that concern an entire alphabet suit of state and (possibly) federal agencies - and criminial charges will be brought by those agencies and the phone company long before you could ever get that into a civil court. Of course, those agencies would also advise you not to say anything about it, particularly to those suspected of doing it.
