In my opinion, this happened because certain elements of society were allowed to have their way with no regard for the Constitution. The funny thing is, it was supposed to be 'for the piblic good' (lung cancer, and all that stuff). However, the lung cancer rate has continued to rise. Asthma rates follow suit. Why? Perhaps the real problem is revealed by a quick revisit to some old (but true) statistics...a major component of diesel exhaust is benzene, one of the most potent carcinogens known to man.
