Anthony, here is a question for ya:

You own copyrighted material, and you see it being downloaded to IP address. The Ip comes back as dsl12655.highspeedisp.us.org.net . You know the material is being downloaded (and worse, shared back out, you went and did a test download from that IP with kazaa). So, now you know there is a copyright violator right there.

The only thing you have is the ISP. Technically, the ISP is the one downloading the content, because you have no proof otherwise.

If they don't get up their client, they could be liable themsevles, because they control the IP, and what is the proof that someone from the company isn't doing the downloading? Remember the DMCA, you don't have to go to court to give notification. For the ISP to say "it's not me" they have to provide the "it's this person here"....

End users should not EVER be able to hide behind an ISPs skirt - end users are responsible for their actions. ISPs are fools if they want to stand between the copyright holder and the violator, they could end up being in an "aiding and abetting" situation, I suspect.

Otherwise, what would stop bob dsl user from setting up paysites with stolen content, knowing that the ISP will never reveal who he is? There is protection and then there is PROTECTION.
