Banned over VS thread on other forum...
:okthumb:
Well it has happened. Anyone following the VS thread on a known shitty board starting with "G" knows whats going on. It's become a ban fest over there as the bro's want to clean house of anyone the knows or cares about the theft that has gone on. The have deleted the original thread now, and any threads related to it, and banned anyone commenting on the theft... Basically putting themselves into bed with the thieves directly. I was banned for stating my opinion on the matter after 4 years of posting and being a member of the board. now, they can well, go fuck themselves. |

What do you think about the Max Hardcore verdict? |
Re: Banned over VS thread on other forum...
I find it worth watching. There are quite a few points about it that are interesting.
I don't feel that it relates to me in anyway for a number of reasons- 1. He was selling DVD's and that was the initial step the government used to bust him. As with most cases, they buy the dvd's or vhs's and have them shipped to a location they want to prosecute in. I have never sold or offered DVD or any other hard copy of the material I provide. I am strictly internet based. 2. His content was WAY over the line... even for most other producers. One of the main scenes they convicted him on showed the model clearly in distress and asking to stop shooting. She was forced to vomit and choke and was pissed on etc. It was beyond acting. In my content, as you know, the models are clearly having fun and enjoying themselves. There is a huge difference. 3. he hosted his content in Tampa on Tampa based servers.... Bad move there all around. This is why they where able to get the community standards issue push on the internet based content. My servers are located in San Francisco with Reliable hosting. But, even so, I'm looking into having them switched to a Netherlands based server. There is quite a bit more to the Max case, and only time will tell how this plays out with is appeal etc. It's something that all usa web masters are keeping a close eye on or should be keeping a close eye on. |
Re: Banned over VS thread on other forum...
Interesting they haven't removed the Jeff Miller Sexstuffsells debacle. I guess he wasn't spending enough money. Maybe Sexstuffdoesn'tsell.

Re: Banned over VS thread on other forum...
I just have to post on this one.... I read that thread in its entirety before it was removed.
It is my opinion that the lifetime agreement would prevail over the TOS account termination clause. How can you make a lifetime agreement ever if at any point it can be terminated and not honored? I have read over the TOS on Video Secrets and yes they can terminate or revoke at anytime for any reason but the Lifetime payout on rebills would still have to be paid don't you think? I do! I just did a little research and found there are cases related to lifetime commissions in the cellular telephone industry and the insurance industry that would apply in this case. I am not the judge but my opinion is one of a jury pool in this country and I would have to way on the side of the affiliate who actually sent the lifetime customer and deserves the commision on the rebill. I actually believe you would win this case. |

When I last had looked at the thread, it had somewhere around 20 Thousand views... So there is no hiding from it now... |
Re: Banned over VS thread on other forum...
I will remind all of you that its not just webmasters and surfers that read Oprano. My server logs are proof of it.

Re: Banned over VS thread on other forum...
You know a lifetime is a lifetime. Is this a hard concept to grasp?
Anything else is a scum sucking rip off. But here's the deal, I gotta say, that the amounts of money we are talking about are so small that any company that is that concerned must be in financial trouble. Imagine that you would put your reputation to the test over peanuts. I sense trouble. Kind of like Jeff Miller and sexstuffsells. I would be pulling my links. |

Re: Banned over VS thread on other forum...
In the end, apparently VS will make it right, but it is more than a little disappointing to see the contortions they went through before deciding to revise their T&C and redefine "lifetime" as an actual lifetime, not the lifetime of affiliates' desire to send traffic.
This is an important issue for many people who have either recently or in process of folding their tents and heading off to other jobs, parking or selling their domains. In times of transition, things like this are just a little more obvious. |
Re: Banned over VS thread on other forum...
It's nice to see VS finally did the right thing, but they can't take back the lame comments that Brad made in defense of their prior policy.

Re: Banned over VS thread on other forum...
Although I disagree with what they did I don't agree that a lifetime is a lifetime. If it's worded correctly you could easily say something like, "This offer good for life as long as you continue sending traffic." Sure, it's good for life if you have to meet the requirement. There are lots of situations where lifetime offers include requirements.
How about marriage? The vows say "till death do us part" but it's possible to get a divorce. If a contract that includes a lifetime clause couldn't include an escape clause it would be illegal to get divorced. What about lifetime brakes? Every seen those offers? What's the clause, the lifetime only applies to the owner of the car at the time the brakes were done. Brake companies know that practically no one keeps a car for a lifetime and very few keep them for more than a few years but they use the word "lifetime" as a selling gimic. Now, what the actual wording of their contract was I don't know because they no longer offer the lifetime offer so at this point everyone is taking the OP's word for it. Frankly I think this whole thing was blown way out of proportion and most of the people that posted in that thread just don't understand how business and advertising work. |
