i beleive we are about 2 1/2 - 5 years away from seeing a massive, complete and total explosion of lawsuits in this area.
this is good summary on the subject reprinted from the NY Times http://www.mercola.com/2002/jul/24/carbs1.htm the US Government and the entire medical community is going to get hit really hard by this issue in a few years. medical science is proving it to be true with each new study. Its one thing to sue MdDonalds, but what about the governments nutritional guidelines being proven to be completely wrong that it caused increased obesity in the US as a result? We are only a few years now from seeing this happen. i am not in any way supportive of Atkins. he is probably proving to be a better marketer than cardiologist, since he has already suffered from one heart attack, both of which are why his name is at the center of this debate. but medical science has been trying to prove him wrong.... and their findings are continuing to prove him right. The legal implications in the US of him being right and winning the high carbohydrate/low carbohydrate debate are almost unfathomable in terms of potential lawsuits. every heart attack.... every extra pound... almost every diabetic etc etc etc... will be blamed directly on the US Government. |

It's all so confusing and I've often thought about suing the government for emotional distress because you just don't know what to beleive.

this is interesting to me. very interesting. i have done a shitload of research this (ketogenic/protein diets) and it is nothing new. weightlifters have done it for 50 plus years.
the reason why it has been easy to attack is because there are no credible long term studies to prove or disprove the positive and negative health effects of the diet. but now, numerous studies are being published today and continue to be published from credible sources like Harvard, Johns Hopkins etc and they are all showing that he is more right than he is wrong. it will be interesting to see what happens. i think that science is going to prove him to be right. if that happens, any professional that advised someone to lower their fat intake and replace those calories with carbohydrates, or someone who advocated a high carb/low fat diet (including the government) can be liable for that persons later health - obesity, diabetes, joint problems, heart disease etc etc. |
... ahhhh, mc donalds all the way !

Yeah it is funny that Atkins is now being proved to be right, after being slammed for years.
And yes Atkins is a much better promoter then Dr., but he appears that he will be vidicated. The problem with lawsuits, all the silly ones we have seen the past 20 years - tobacco, guns, etc... come from TRIAL LAWYERS who are looking for any deep pockets anywhere to LEGALLY STEAL FROM. Trial Lawyers are the problem not the answer.... peopel do not realize the billion dollar bullshit settlements they get are passed down to ALL of us in expenses! We need TORT reform now! |

the government and entire medical community can be liable for 20 years of increased obesity, diabetes, heart disease etc etc. i mean if smokers can successfully sue cigarette companies for billions, then this issue is FAR greater than the costs to health care, insurance and health than those of smoking ever could be... all the same logic and even a stronger case can be made against the government/medical community because there was not a conspiracy. they dont have to prove a conspiracy or anything weird. people were simply told how to eat and what was told to them was false and even the complete opposite of the truth. they continued to tell people to eat this way, as people lowered fat in their diets and obesity/diabetes and heart disease sky rocketed. something weird will happen in the next few years. there are several high-profile lawsuits against fast food restaraunts right now... imagine McDonalds suing the federal government for say "misleading the public into believing their food was more harmful than it is" ... namely centered around the calorie and fat content. i can see this whole situation getting really weird. imagine all fat people having someone to blame legally and financially! it will be insane. more than half of our population is clinically obese. I blame the fact that I can't seem to find a decent skinny girl on the US Surgeon General.
Edd and I are members of the anti-fat lobby. We're pro 'free trade' with Asia. We'll take whatever they have to offer. C. |
