This has to be the funniest thing I've seen in a while.

1st - I get a letter addressed to "Mike No-last-name" at Wyldesites, Inc.
2nd - Telling me I'm in direct infringement of their patent, etc. ,etc.
3rd - Urges me to 'take advantage' of their introductory rates!!

hahahahaha!!!!

These morons have got to be kidding right? What is the criteria for even getting one of these letters? Just because you service the adult industry means you owe them money??

I guess they never even bothered to look at what exactly it is that I do?? Oh boy ..

you should file an extortion claim mike.

you'd likely win very quickly.

Extortion (Black's Law Dictionary - 6th Edition) is defined as:
"The obtaining of property from another induced by wrongful use of actual or threatened force, violence, or fear, or under color of official right."

I got mine today too.

Unfortunately, it is doubtful that the revenues generated by the vast pornodoggy empire would pay for the sugar for the acacia coffee service on a monthly basis.

And, uh, there is the little factor that I have no audio and no video anywhere on anything ...

Carrie 10-23-2003 04:40 PM

I haven't checked my mailbox - now I'm wondering if I should. From this and some threads I've seen on GFY, it looks like they sent out another wave of packets.
Guess they're getting tired of having to post losses in their quarterly statements. Anyone else notice the timing of each swarm of packets as it relates to the release of quarterlies?

PD - hahahaha! Yeah I hear you ... what they would get out of me wouldn't keep the bathroom stalls clean!

And again .. there's the issue - I dont stream anything to anyone!

Looks like they are digging further and further down the food chain if they are hitting up the little man like us!

I have but one thing to say to them ... :moon:

I was thinking that too .. out of the 52 licenses they say they have issued, they referenced 6 companies by name in my letter .. and I've done work directly for 4 of them ...

Carrie 10-23-2003 04:49 PM

Mike I bet if you challenged them they'd try to use Flash as an excuse, when Berman still hasn't given a straight answer as to whether or not his patent covers Flash.

I think the No-Last-Name thing is priceless, though. We don't know who in the hell you are but we're gonna sue you if you don't pay our bribe money!

Naw... you guys couldn't possibly do any more damage than has already been done to this state. In fact, pissing on that particular lawn might be viewed as a community service! :awinky:

PornoDoggy 10-23-2003 04:54 PM

Carrie, while I'm sure that they obtained my address from one of the programs that settled with them, the timing of the mailing is likely related to when they obtained the data and to the November 30th deadline for the "hassle-free" settlement. It provides them an opportunity to later say to a court, "See, we tried to be reasonable..."

I have to admit, though ... tying the mailing date to the release of quarterly statements, like speculating that there has been no hearing on this matter because a court clerk owns Acacia stock, is much more in line with the hysterical and ill-informed nature of most posts on most boards about the whole topic.

Peaches 10-23-2003 04:56 PM

I won't be in Atlanta to pick up my mail until next week. It will be interesting to see if I got one (I have NO video on ANY of my sites and my sites are all free) and if so, what name it's under. :P

Not to spam other boards, but everyone receiving packets all at once is kinda important.
Alex gives a good response in this thread to some folks that got theirs today, and there are so many new threads on GFY saying they got a packet today that I just did a one-week search for 'acacia' and came up with 85 freaking results. Lots of good reading in some of those.

PD, the quip about the clerk was a funny. *bonks you on the head*
Packet mailings in relation to quarterlies isn't, though. Think back over the dates when the board have previously been overrun with "I got my packet" threads.

They do send out singular packets constantly it seems, but there have been a few cases now of huge batches of packets going out and I swear it coincides with when we were talking about their quarterly earnings.

Now you've made me curious and I'll have to go digging and checking dates. Dangit! As if I didn't have enough to do... :P

Macromedia has the lawyers and the money to crush them in court. Same reason they haven't sued Microsoft or Real Networks - although they *claim* they haven't sued these companies because they want the people using the technology, not the ones who make the technology.

I wonder when they come after the board owners

mojobill 10-23-2003 05:17 PM

Couldn't you mail the thing back to them saying truthfully that "Mike No-last-name" does not live there nor is do you employ anone by that name?

Peaches 10-23-2003 05:19 PM

Does anyone have a list of ALL the companies who have settled? I don't have a lot of affiliate accounts and so far, unless CQ was grouped in the settlement with LFP, I don't think I have affiliate accounts with the folks that settled. So...if that's the case AND I get a packet, that would mean they're getting the info somewhere else.

Apparently people who don't even HAVE adult websites are getting letters. I wonder if that mean Confucy will get one. :) She'll be able to finally say she has something in common with adult webmasters. :okthumb:

Carrie 10-23-2003 05:47 PM

Mike, PD, have you guys ever bought any content from Matrix?
It seems that folks have nailed it down that Matrix is the one giving out information to Acacia here:
http://gofuckyourself.com/showthread.php?s...threadid=189275
and in a few other threads.

Hooper 10-23-2003 05:50 PM

matrix was asked to give out their customer lists. i dont think that was a secret.

acacia put the squeeze on them very hard very early and put a lot of financial resources into getting their lists.

Never did purchase anything from Matrix. I have affiliate accounts with a number of the companies that have settled, however.

Guess we'll see how good this agreement that Flynt affiliate income is exempt from this extortion is.

PD in order for that to work, I would think that Hustler would have to be your *only* sponsor.

Reading over some of those threads and in particular an exchange between MikeAI and Platinum Dave has me sitting here simply fucking stunned at the audacity, stupidity, and purely felonious activities that some people are willing to admit to on public boards.

Edit: Actually what has me even more stunned is that people continue to do business with them after shit like that has been admitted to. Why risk your business by aligning yourself with something like that? If that person will publically admit to doing that kind of thing, what makes you think he'd be more scrupulous and upstanding when it comes to business agreements between the two of you (or your companies)?
Ridiculous.

I am glad someone noticed. I was pretty shocked as well. He is not to bright apparently.

My other question is why would a Canadian corp settle? There is more here then we are being told.

Carrie 10-23-2003 06:06 PM

Mike, the real question is - has anyone reported it to the SEC?

Probably not, but it is something that should be done. I wonder what steps have to be done. I cannot imagine just going on the website and submitting the information would do much.

I responded to this on GFY also :awinky: but CE's an offshore company which settled. I would ASSume that if you did business in the states (i.e. have US customers, use US processing, etc.) then you'd be required to follow US laws. If not, then anyone could open up a shop offshore and start making every patented product known to man and sell it here.

That's my thoughts. They're just sending out letters not even checking sites to see what is really going on or what type of site it is.

Are they hoping that with every letter they send out some moron will just right off the bat agree to send them cash?

Peaches there is a difference between people setting up offshroe companies to play games, but still live in the US, and true Canadien corporations with the owners living in Canada.

Dravyk 10-23-2003 06:17 PM

Just talked with a webmaster. His "wife" (they are not legally married) got her Acacia letter today. All domains are in the "hubbies" name not hers. The name on the letter is not her legal name. She has it on no legal doucments. It is not listed on any registrar. Nor is her real ("maiden") name.

She did use that name *one single time* when she did hubbie a favor and filled out a sponsor-affiliate join form and she put that down as a "lark" for the contact name. So she knows it came from only one place, a sponsor who settled with Acacia and then swore up and down on the boards that they did not give their webmaster list out to them.

Surprise, surprise. Not.
