Damn! I wondered where Bradley got the prenup ;)
A prenup as in 'Yes I love you but I thing you are a money grabbing bitch and I need to protect myself for the day when you walk out on me me'?

Never quite got the point of a prenup ... it says 'i'll love you forever but just in case, here's my protection'

Remember ShawCutie, without it, you own HALF!

Monk 06-29-2003 07:02 PM

Brad/shawcutie aside;

Aren't prenups just being realistic?

Don't 95% of people go into marriages thinking they will work out famously? Only half those people turn out to be right.

What's wrong with using your noggin to realize things don't always turn out like you hope they do?

Peaches 06-29-2003 07:26 PM

If I'm not mistaken, in most states, the only thing really "divided" up at the end of the marriage are the assets created IN the marriage. I know when my parents got divorced, even though it never went before a judge, there was never any question that my Dad was NEVER getting a dime of my mother's money from her family.

The only times I've seen a legitimate reason for prenups is if there are children coming into the marriage that weren't born to the couple IN the marriage. Most of these consisted of "And I will not be responsible for little Jimmy's private school if we get divorced, because he ain't mine!". Or if there's a lump sum offering in case of divorce, in which case it becomes a business proposition, not a marriage, IMHO.

I guess this is one reason why I haven't gotten remarried in the 19 years I've been divorced - I'm not a big fan of all the rules and regulations people set up BEFORE the marriage in regards to the DIVORCE.

*KK* 06-29-2003 07:35 PM

Hahaha, cj, without a wedding there's only one half ;)

A marriage is many things. One of them is a partnership. And there is money and property being handled in that partnership.

Marriage aside, would you enter into a business partnership with someone, no matter how much you trust them, without a written agreement?

If either or both sides have significant assets before marriage, I think a pre-nup is a good idea. There's nothing emotional about it, it's just a good precaution. You're not planning to die when you have a Will written, why is a pre-nup any different?

Vick 06-29-2003 08:06 PM

I always thought having a pre-nup was planning for failure

You're going into a partnership expecting it not to work out and trying to prevent yourself from getting fucked

But then again what do I know

No one (that I know of) enters into a business relationship with the agreement that it will last until one of them dies. And unless you're telling us more than we thought about your relationship with Gonzo, you're not in love with your business partner. B) And a marriage IS a contract, without a prenup.

I think you proved everyone who's against the prenups point - you get a will written because you know 100% that you're going to die. A prenup, IMHO, says you know you're going to get a divorce. :awinky:

He made a bad point but I don't think it proves anything for anybody else.

The point of a prenup is not comparable to a will. You are not saying you believe 100% that your marriage will fail... you are just saying that realistically, not all things go as you hope they will..... and 50% of the people find this out the hard way.

Exactly - which is why I don't believe in getting married. If you don't GET married, It alleviates all talk of prenups. :okthumb:

However, I'd love to see the stats on people that got divorced that didn't have a prenup, and would have been better off if they had. From what I can tell, with a good (read: expensive) lawyer, most prenups are tossed out the window as soon as the divorce hits.

Vick 06-29-2003 09:40 PM

One very important and valuable lesson I learned from Serge
Negotiate with the children and not the spouse in case of divorce!!! :o

cj 06-29-2003 09:43 PM

>>You are not saying you believe 100% that your marriage will fail... you are just saying that realistically, not all things go as you hope they will

then people should stop getting married just because its the thing to do ...
its obviously not the solution to a good relationship between 2 people, especially when its justifiable to have a prenup.

If 2 people love each other and enjoy each others company, why do they need to get married at all to prove that? The wedding is usually the point where it starts to go downhill - nothing left to look forward to except some screaming brats.

And yes, before anyone else says it, there are exceptions to every rule - i'd say its 1/50 couples who have a chance at a fulfilling life together - and just because a marriage doesn't end in divorce doesn't mean its a happy union.

Fuck marriage
Its the biggest crock of shit our society has come up with. wtf does an overpriced white dress & some throw away table decorations have to do with happiness?!

Jane Welch, anyone ;))))))

cj 06-29-2003 10:31 PM

Jane Welch ... i had to look that one up ;-)

If I ever get married, I plan on having an italian chauffeur too! :bjump: in fact, i think it should be a clause in the prenup :biglaugh:

Hell Puppy 06-29-2003 10:34 PM

Ok, a Will is a bad example. Maybe insurance is a better example. Or maybe think of it as kind of an "extended warranty" for the marriage. Whatever...

I just dont buy the argument of a pre-nup is planning for failure and not making a lifetime commitment. It's just a matter of being prepared for any eventuality. And with a divorce rate of 50%, it makes good sense.

Dont get me wrong. I very much believe marriage should be a life long commitment. My grandparents just celebrated their 65th anniversary, and my parents are working on number 44. Rest assured if I ever get married, it is my intention to take that "til death to us part" line seriously.

Afterall, a Smith & Wesson is cheaper than a pre-nup anyway.... :awinky:

Monk 06-29-2003 10:44 PM

You guys don't have common-law spouse laws in your countries that basically deem a person to be your spouse once they have lived with you for a certain # of months?

GA used to have a common law marriage law, but took it off the books several years ago.

My Dad has lived with my "Stepmother" for....gosh....15 or so years. They wear wedding rings, own property together and even go to marriage counseling - but never got married. They've done the power of attorney thing and wills and that's all they need. They laugh and say they're waiting to see if it's real. :awinky: Maybe someday they'll get married. They'll probably be on vacation somewhere and decide on it, knowing them. But when you're older and kids aren't going to be conceived, there's not a huge reason to do it, IMHO.

In all fairness, getting divorced has always been my fear - not really getting married. But I'm weird anyway. B)

Hell Puppy 06-30-2003 12:57 AM

We all need to marry eventually just so we'll have someone to wipe the drool from our chins and change our bed pans when we get old.

slavdogg 06-30-2003 05:09 AM

i like African marriages, men not only get a half naked wife but also a dozen or so sheep
And they seem Happy.

I'd rather spend my time getting rich so I have a cute male nurse to wipe the drool :awinky:

Besides CJ's excellent suggestion, the reason you HAVE kids is to make yourself a burden on them when you get older. :awinky:

Like I tell my son, I fed you and changed your dirty diapers, you shall do the same for me. Frankly, I think he already has the numbers of several nursing homes on speed dial.

hhmm.. Well a wise man once told me
"Agreements are made in the Good times for the Bad times"
and just quietly I recon he was right...Divorce rates up there as one of those bad times.
Unfortunatily once emotions enter the negotiation, often logic and good sense depart.

Remember the old Uni adage "No one plans to fail, but many fail to Plan"

We can swap nurses occasionally for variety ;-))))

My parents can fend for themselves ... they've already told my sister and I that they are taking a SKI holiday when they retire (Spending Kids Inheritance) so we told them we would only have enough money to put them in a really cheap home :biglaugh:

I saw this about marriages and thought of this thread:

It is establishing a relationship in which the independence is equal,
dependence is mutual and the obligation is reciprocal.

Cassie 07-01-2003 03:11 PM

life sure was directed back then eh? man did his thing, woman did her thing and never the two crossed until the man decided he liked the look and feel of pantyhose....lol
